1. Scope of Application
1.1 TIXPI operates a digital platform for arranging transport services for normal or bulky goods (hereinafter “Services”). The platform connects clients with contractors.
TIXPI acts exclusively as an intermediary and does not become a party to the contracts concluded between the client and the contractor.
1.2 The entire legal relationship between TIXPI and the client is exclusively subject to these General Terms and Conditions (GTC) in their current version. By submitting an order via the platform, the client acknowledges these GTC as binding.
1.3 The GTC also apply to future uses of the platform. In the event of differing, individual agreements, these take precedence over the GTC, provided they have been agreed upon in writing.
2. Contractual Relationship
2.1 The service contract for the transport service is concluded exclusively between the client and the contractor.
2.2 TIXPI assists as an intermediary in organizing the transport. However, TIXPI is neither responsible for the performance of the service nor liable for any breaches of duty by the contractor or the client.
2.3 TIXPI charges an mediation commission, which is already included in the total amount paid by the client.
3. Rights and Obligations of the Parties
3.1 The client is obligated to settle the full outstanding amount for the transport in cash immediately upon completion of the work at the destination. The handover of the payment to the contractor or their authorized representatives concludes the contract.
3.2 The client undertakes to provide all information relevant to the service completely and correctly. In particular, information regarding transported goods, accessibility, floors, lift availability, and parking facilities must be accurate.
In the event that the information provided by the client regarding the effort required (information on floors, lift availability, etc.) for the transported goods differs from reality and this leads to additional effort for the contractor, the contractor has the right to:
- Perform the service according to the information provided by the client (and not undertake more effort than agreed upon),
- or – if both the client and the contractor agree – invoice the client for the additional effort required to fulfill the service at the cost rates for the agreed scope of the service. This will be recorded on site.
- If the contractor and the client cannot agree on one of the above options, and the client refuses to accept the service to the agreed extent, the compensation rights according to section 4.0 regarding cancellation apply.
3.3 The contractor is entitled to charge the client for additional work resulting from incomplete or false information (e.g., undeclared furniture), or to refuse transport. A tolerance applies to moving boxes: an increase of up to 15% over the number originally stated by the client will be accepted at no additional cost, provided that other items are also being transported for the client. For each moving box that exceeds this tolerance limit, the contractor is entitled to charge the client for the additional work on-site. Should the scope of the goods to be transported increase, the client is obligated to notify the contractor immediately. The telephone number necessary for this notification can be found on transport confirmation.
3.4 If the client is delayed by more than 30 minutes, the contractor can cancel the assignment. In this case, TIXPI is entitled to charge the client up to 100% of the agreed remuneration.
3.5 The client undertakes to ensure the necessary accessibility, parking facilities, and secure packaging of sensitive transported goods (e.g., glass, electronics, plants, feet of objects that can scratch the floor). Otherwise, the contractor is exempt from liability.
3.6 The client must inspect the transported goods immediately upon completion of the service. A notice of defects, including immediate photos of the identified damages, must be sent to the contractor and a copy to TIXPI (info@tixpi.ch) within 24 hours of the completion of the entire service.
4. Cancellations and Appointment Changes
4.1 Appointment changes are not provided for. In this case, the client must cancel the order and rebook. A refund is excluded. The contractor reserves the right to make further claims for compensation for demonstrable additional costs.
5. Liability
5.1 TIXPI is not liable for damages, delays, or other breaches of contract between the client and the contractor.
5.2 Exclusion of Contractor Liability
The contractor is exempt from liability if loss or damage was caused by fault of the client, an instruction given by the client, defects in the transported goods, or by circumstances over which the transport company had no influence.
In the event of breakage or damage to particularly vulnerable items such as marble, glass and porcelain plates, stucco frames, chandeliers, lampshades, radio and television sets, computer hardware and software, as well as data loss and other highly sensitive items (plants, animals, etc.) (“Fragile Items”), the client is obliged to point out that these are fragile items and to carefully pack and label the fragile items. If the client fails to comply with this obligation, the transport company’s liability is excluded.
6. Data Protection
The processing of personal data is carried out in accordance with TIXPI’s data protection policy and in compliance with the Swiss Data Protection Act (DSG).
